Care Plan Terms

1. What this covers

These terms apply if you take up an ongoing care plan for your website with BrightAndBuilt (Giovanni Giordano, ABN 77 210 579 553). They sit alongside, and do not replace, our Terms of Service, which govern the original build of your site.

2. Fee and free trial

Your care plan fee is as confirmed at signup, plus GST where applicable, shown on your invoice, billed monthly by subscription. The first 30 days of your care plan are free. You can cancel during that first 30 days at no charge and no obligation. If you do not cancel, billing starts automatically once the free trial ends, as disclosed to you at signup.

3. What's included

Your care plan includes hosting, SSL, and content delivery for your site; uptime monitoring; regular backups; a limited amount of content edits each month (changing your phone number, hours, a photo, a price, or a review, for example); and a performance report, at the frequency set out for your specific plan tier at signup.

4. What's not included

Your care plan does not include new pages or sections, campaign or advertising work, copywriting beyond light edits, or any change beyond the monthly edit-time allowance for your plan tier, unless your plan tier specifically includes it. Anything outside your plan's inclusions is quoted separately before we do the work, as quoted in your agreement.

5. How change requests work

You send us a request (by email, or another channel we've agreed with you) describing the change you want. We make the edit on a staging version of your site first, and only publish it live once you approve it. We do not make live changes to your site without your approval.

6. Cancelling

Either you or we can cancel your care plan with 30 days' written notice. There is no minimum term beyond that notice period. Cancelling during your free trial, as set out above, requires no notice period and no charge.

7. What happens when you cancel

If you cancel, we will give you an export of your site's files within 14 days of your cancellation taking effect, and release your domain to you if we are holding it on your behalf, so you can arrange your own hosting. We do not withhold your site or your domain as a condition of cancelling.

8. Refunds

Cancelling does not entitle you to a refund of the current month's fee already charged. Your plan runs to the end of the billing period you have already paid for.

9. Price changes

If we need to change your care plan fee, we will give you reasonable advance written notice before the change takes effect. If you don't want to continue at the new price, you can cancel under clause 6 before it applies to you.

10. Your consumer guarantees

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.
